“Today, VAKS is degrading and turning into a typical post-Soviet court with the same post-totalitarian approach. The cancellation of IQ tests and knowledge of Ukrainian history is a logical continuation of this process,” the expert wrote.

He noted that the relevant committee of the Rada recommended the adoption in the second reading of bill 11425-d, which removes the requirement for a 75% passing score for cognitive testing (IQ test). Along with this, there will be no testing on the history of Ukrainian statehood in VAKS competitions.

“What does this mean in practice? The High Qualification Commission of Judges will independently determine what the IQ test will be. Considering that current judges are not acting very wisely – buying luxury cars and real estate, following the instructions of NABU and SAP – there will either be no test at all, or it will be simplified. For instance, candidates might be asked to color by numbers or solve puzzles,” Posternak reported.

He reminded that recently the European Commission stated in a shadow report that the High Anti-Corruption Court is becoming increasingly dependent on NABU and SAP, which systematically violate constitutional human rights. He also cited the example of lawyer Rostyslav Kravets regarding how VAKS judges completely blocked the court's work for one day.

“Recently, VAKS judges outdid themselves – on November 8, they effectively declared a strike and decided as a full assembly… not to show up for work! All indictments and motions submitted that day remained unassigned (including the criminal proceedings against the current MP). The reason for such absurd behavior is remarkable. It turns out that half of the judges went on a business trip abroad, while the other half took a vacation to prepare for the exam in the appellate chamber of VAKS,” Posternak wrote.

However, in principle, in his opinion, the cancellation of tests could benefit the judicial system.

“After all, as experience shows, the more time VAKS judges spend on vacations, the greater the chances for fair justice in the country,” the expert concluded.
